HIS Advocates, s.s.m. and HISAdvocates.org hereinafter referred as HISA
control a website known as HISAdvocates.org which is a private
ministry/social platform wholly managed by HISA and does NOT practice
law or give legal advice.
The following describes the Terms of Service Conditions hereinafter
“TOS” of use for HISA website known as HISAdvocates.org.

HISAdvocates.org you are hereby acknowledging our complete Terms of
Services posted here.

States [Title 28 Section 3002] in the private.

private/un-incorporated membership association known as a church
ministry/social platform wholly managed by HISA leadership and does NOT
practice law or give legal advice.
HISA reminds the people to obtain proper legal/lawful counsel to
determine the best approach for each specific situation.

Oklahoma Court Rules and Procedures, Title 12, sec. 2017 (C) "If an
infant or incompetent person does not have a duly appointed
representative he may sue by his next friend or by a guardian ad litem."

(377 U.S. 1); Gideon v. Wainwright 372 U.S. 335; Argersinger v. Hamlin,
Sheriff 407 U.S. 425. Litigants may be assisted by unlicensed layman
during judicial proceedings.
NAACP v. Button (371 U.S. 415); United Mineworkers of America v. Gibbs
(383 U.S. 715); and Johnson v. Avery 89 S. Ct. 747 (1969). Members of
groups who are competent non lawyers can assist other members of the
group achieve the goals of the group in court without being charged with
"Unauthorized practice of law."
All information such as the blogs, forums, foreclosure calls,
consultants, or vendors that are made available on HISA is for
educational purposes only.
Moderators are NOT licensed attorneys, they do not provide legal advice,
nor do they receive any income from HISA.
Moderators simply share their private experiences or point people
to forums or directories in which to help "The People".
HISA does not always agree with any or all of the information and
is not responsible for how people use it.
Each individual/person/people must do their own study and make
their own decisions, if and how any of the information on the website
might help them with their issues, and consult with a bar carded
attorney or private counsel if advice is needed.
HISA reserves ALL of our Rights under GOD, without Prejudice, and
without Recourse.

The following are the rules, or Terms of Services, that govern
your use of the HISA website services. By using HISAdvcoates.org, you,
hereinafter you the member, expressly agree to be bound by the TOS. The

As laws governing website TOS’s are updated, we reserve the right
to make changes to this TOS to reflect those updates which will be
submitted to you for acceptance or refusal.
If you violate the TOS, we may cancel your free or your premium
membership and/or take appropriate action against you.
WHO WE ARE: HISA – We are a
Private Un-Incorporated Self Supporting Church Ministry known a Private
Membership Association. HISA
website may contain information that is proprietary, privileged, trade
secret, or otherwise protected by international law against unauthorized
use or disclosure. It is protected by PRIVILEGED INFORMATION.
EDUCATIONAL INFORMATION:
HISA website and any emails, file[s], videos, audios, forums, blogs,
chats, calendars, or attachment [s] transmitted within the website, are
transmitted on a reasonable expectation of privacy. Information from the
website is encouraged to be shared with other members only.
We are a third party facilitator for various vendors, lawyers,
corporate and private parties. This is in no way a solicitation for
their services or any implied contract for services or agency
relationship. No relationship has been established for any agency
relationship or legal representation whatsoever.
LINKS TO OTHER WEBSITES: All
websites linked with HISA are independent, and we have no control over
their content, nor do they represent an endorsement.
FEDERAL DE-FACTO OR STATE EMPLOYEES:
We welcome you to join the HISAdvocates.org website for
educational purposes to gain knowledge, understanding and consent that
none of what you find on our website can be used in any action lawfully
or un-lawfully against leadership or assigns of HISA.
All directors of this ministry are private Americans.
We do not claim and are NOT United States or sovereign citizens.
We are very pro-government.
This church ministry is in fact within a legal null.
There is no law (other than GOD’s law) for a ministry such as
ours! We bless you in the
name of our LORD YESHUA (Jesus) and ask that you investigate the fraud
that will affect your children’s children.
The fraud and theft of our Republic, our land, our wealth and our

CONTRACTING THROUGH THE BLOG OR FORUM WITH MEMBERS:
HISA is a private ministry focused on helping homeowners through
education, communication, educational, and facilitation of services
through another qualified representative’s as a facilitator only. Any
fees/donations received from you to HISA for services rendered by any
forum leader, worker, will only be between you and HISA. You are not
authorized to contract with any forum leader in a private manner outside
of HISA for services that are related to HISA.
SELLING OF YOUR GOODS OR SERVICES:
You are NOT authorized to sell your goods or services through
this website unless expressly approved prior to any post that you place
onto the website. We are an education platform only. HISA does not and
will not contract for services other than education.
NO LEGAL ASSISTANCE: HISA is
a private self-supporting church ministry. Please be advised that at any
time you are in need of legal assistance, please contact a lawyer for
your legal advice as HISA is in no way contracted with you in any legal
transaction.
CONDUCT: You agree to
conduct that would not constitute a criminal offense or civil liability
or otherwise violate any law when using the HISA website.
SUB WEBSITE KNOWN AS GROUPS: HISAdvocates.org has many sub websites
known as groups. These sites
are private in nature and not considered public.
The information contained within these groups is only there for
educational purposes only.
Please make sure that you verify all content as being accurate for your
own specific needs.
DOCUMENTS: Members
downloading documents do so AT THEIR OWN RISK OF USE. We do not warranty
or guarantee any of the documents to be complete or accurate. You must
inspect the documents yourself and gain sound legal/lawful advice before
you submit these documents to any person, people, corporation, agency or
governing authority. These documents have worked at various levels of
success for other members and helpers and we are only
interpreting/sharing them with you so that you too can be successful
based on our experience we have had with other members and friends.
COMMUNICATION: All
communication done with our trainers, forum leaders, blog leaders is
written or verbally communicated based on personal experience. Such
communication does not constitute an “attorney/client” relationship.
VIOLATIONS: Do not copy or
transmit any information outside this website. It is for the intended
purpose of HISA VIP Members use only. You are hereby notified that any
dissemination, distribution or copying of this website material to any
person, man, entity, individual, person, corporation, or agency outside
of HISA is strictly prohibited.
SANCTIONS: HISA is a private
informational ministry. Freedom of speech is not an absolute right in a
private setting. The purpose of the site is to provide constructive help
in a spirit of peace and respect. Posts that produce discord through
profanity, SHOUTING, personal attacks and insinuations against motives,
character, intelligence, etc. will be edited or deleted. Posts that are
off topic may also be moved or deleted at moderator discretion. Posts
should only be put on the appropriate blog or forum. New topics or
issues should not “piggyback” existing threads. Questions over site
policies, problems with site functions, and complaints over moderations
should be addressed directly and only to ministry@hisadvocates.org.
After the second warning for violation of these TOS, a member may
be banned from the site without further notice. No refunds will be
issued in the case of terminations due to TOS violations.
INDEMNIFICATION: You agree
to indemnify, defend and hold harmless HISA, its website, officers,
directors, members, third party information and or services providers to
our website from and against all costs and damages, expenses, losses,
including reasonable attorneys’ fees, that result from your use of HISA
website or violation of the TOS (including wrongful conduct or
negligence) by you or any other person you may or may not allow to
access our website. You
agree to indemnify, defend and hold harmless HISA website for any
unforeseen natural and/or man-made disasters affecting this website, and
its Email and website communications.
HOLD HARMLESS/RELEASE: For
and in consideration of the mutual promises and agreements set forth
below, HISA/HISAdvocates.org and you, the member agree as follows to the
following covenants:
EXEMPTION FROM LIABILITY:
You hereby fully and forever discharge and release HISA and/or assignees
from any and all liability, claims, demands, actions, and causes of
action whatsoever arising out of any damages, both in law and equity, in
any way resulting from legal, personal, physical, psychological or
emotional injuries, distress, or death arising from or in any way
related to the educational assistance. This release from liability
includes loss, damage or injury resulting from the negligence of HISA
and/or assignees from any other cause or causes.
In no event shall HISA, affiliates, or suppliers be liable for
any special, incidental or consequential damages arising out of or in
connection with this ministry, our web site, our services, or this TOS
(however arising, including negligence).
NO WARRANTY: HISA, our
affiliates, and our suppliers provide our services “as is” and without
any warranty or condition, express, implied or statutory.
HISA, our affiliates, and our suppliers specifically disclaim any
implied warranties of title, merchantability, fitness for a particular
purpose, completeness, timeliness, accuracy, reliability, and
non-infringement.
USE OF HISA WEBSITE: You
accept, agree, and acknowledge that HISA website does not claim to give
expert or professional advice in any area, that information on HISA
website is not legal advice, nor does it create an attorney-client
relationship. Use of this
HISAdvocates.org website is completely at your own risk.
IN OUR BLOG SECTIONS: Do not
post anything that is copyrighted, unless you are the owner or have
approval of the owner.
RESTRICTED ACCESS: Most of
HISA website is restricted for our VIP Members.
With VIP Membership, you may not share your user ID or password.
HISA website leadership may disable your user ID and password if
you breach any of the TOS.
VIRUSES, etc...: HISA does
not warrantee or guarantee any files you download throughout website to
be free of worms, infection, Trojan horses, or other destructive or
contaminating code. It is
your responsibility to safeguard your computer/devices with adequate
protection.
TERMINATION: The member may
cancel these Terms of Service by email (ministry@hisadvocates.org)

HISA reserves rights to cancel any membership for any reason as
it is a private membership association.

EXCLUSIVE NATURE IN EDUCATIONAL ASSISTANCE:
You acknowledge the Private Nature of this service and some
copyrighted information you will be provided. You agree NOT to share the
information with others without permission. You acknowledge the
liability to yourself for providing this information to others who may
use it improperly.
CONSENT TO RECEIVE ASSISTANCE:
You acknowledge that you are fully and satisfactorily informed
about what is offered by HISA and that you freely and willingly are
choosing to receive their educational assistance at this time.
You understand that the educational assistance may include
written communications, conversations in person as well as on the
telephone and you understand that you may freely choose whether or not
you will receive, take and/or act upon said educational assistance.
You hereby consent to the digital recording (Voice or otherwise)
of any communication, phone call or conference call in reference to any
HISA leader, director or assign.
Educational assistance is NOT legal advice or educational and
should NOT be considered as such.
You understand that you are personally responsible for all your
actions, including actions that are of a “legal nature,” and they are
freely taken as your own, regardless of the education given and/or
outcome. You understand that
the HISA and/or assignees are NOT a law firm and we are NOT a
“lawyer(s)”, “bar attorney(s)” or paralegal(s). The educational
assistance is NOT psychotherapy, medical therapy or advice, neither is
it a substitute for any of these.
You understand that the educational assistance may or may not
involve the facilitating of a “Power of Attorney” service, and if you do
not consent to this, you will tell HISA and/or assignees that you object
before or at the time the signing of such a document or agreeing to
these Terms of Services. You further understand that the nature of
dealing with the governing authorities, courts, police, the de-facto
Federal government, STATE government and your Rights, Freedoms and
Liberties involves serious issues and you may experience, including but
not limited to: deep emotions and possibly emotional stress, anxiety,
tears, physical discomfort, or exhaustion. You will anticipate this as
your responsibility and will expect this to occur.
You do not have any doubts about your mental health and/or
emotional stability with regards to handling the rigors of the
educational assistance. You have resolved any such doubts you may have
had about the educational assistance by consulting those who are
knowledgeable about “legal matters”, including but not limited to, a
lawyer, attorney, physician, psychiatrists, psychotherapist, or
psychologist. Such person(s) to your understanding have no objections to
your receiving educational assistance.
You understand HISA, their assistants and staff are not your
fiduciaries and you do not expect the educational assistance to be
administered with the standard expected of trained legal professionals.
If you feel that you are not getting the proper assistance you expect
during the educational assistance, you promise to inform HISA
immediately. You understand
you are free to reject any aspect of the educational assistance at any
time for any reason. If during the educational assistance you feel you
need assistance from anyone, either professional or otherwise, you take
full responsibility for rejecting the educational assistance and
obtaining such professional assistance.
INSURANCE DISCLAIMER: You
understand HISA does not provide any bond or insurance (neither medical,
liability, nor incident) for you during your participation in the
educational assistance. Thus, if you want assurance or insurance of any
kind, it is your responsibility to obtain such assurance or insurance at
your own expense.
RELEASE OF HISA AND/OR ASSIGNEES: In consideration of HISA and/or
assignees allowing you to participate in the educational assistance,
you, on behalf of yourself, your heirs, executors, administrators, and
assignees, hereby elect the following RELEASE provisions:
ASSUMPTION OF RISK: You are fully aware that participating in the
educational assistance may contain risks of legal injury. You know and
fully understand the scope, nature and extent of the risks involved in
the educational assistance and activities contemplated by this
Agreement. You voluntarily and freely choose to incur and assume any and
all such risks and dangers.
If you choose you will be giving up certain valuable legal rights to sue
HISA and/or assignees, their families, trustees, officers, directors,
employees, agents, representatives, volunteers, staff, and/or successors
(if any) for any personal, legal, physical, psychological, or emotional
injuries you may suffer as a result of the educational assistance.
COVENANT NOT TO SUE: You agree NOT to institute, initiate, or assist the
prosecution of any suit, claim or action at law or equity, or otherwise
against HISA and/or assignees for damages which you or your heirs,
executors, administrators, or assignees hereafter may have arising from
or in any way related to the educational assistance.
This release from liability includes loss, damage, or injury
resulting from the negligence of HISA and/or assignees from any other
cause or causes.
INDEMNITY: You agree to indemnify and hold harmless HISA and/or
assignees from any and all losses, claims, actions, or proceedings of
any kind which may be initiated by yourself and/or any other person or
organization on your behalf against HISA and/or assignees. This
indemnification includes reimbursement of all legal costs and reasonable
“legal” fees incurred by HISA and/or, to defend any such actions.
WAIVER OF PUNITIVE DAMAGES: You understand and agree that you are waiving and forever abandoning any claims for punitive or exemplary damages against HISA and/or assignees. You voluntarily choose to give up this Right.
MEDIATION THROUGH MATHEW 18: You agree that any controversy claim
against HISA and/or assignees not released herein, arising out of or
relating to your participation in the educational assistance, shall be
settled by private men of GOD in accordance with the HOLY Bible, and not
by lawsuit or resort to any court process in any jurisdiction. This
shall apply to all claims including allegations that there have been
wrongful acts or omissions by HISA and/or assignees either intentionally
or otherwise. By agreeing to
these Terms of Services, you are agreeing that any issue or claim
arising out of your participation in the educational assistance shall be
decided by neutral private mediation. You are giving up your Right to a
trial by a Jury or Judge.
AGREEMENT RATIFICATION: GOVERNING LAW: You understand that this
Agreement shall be construed and governed by the laws of the de-jure
California state Republic assembly, without the United States (Title 28
Section 3002) or STATE OF CALIFORNIA (Federal Government(s)) and that
this agreement cannot be modified unless in writing and signed by both
parties.
ENTIRE AGREEMENT: You understand that this Agreement contains all the
promises and agreements between the parties with regard to the release
of HISA and/or HISA assigns and you acknowledge there are no oral or
written promises or agreements outside of this Agreement regarding the
release of HISA and/or his assignees.
BINDING: You hereby expressly recognize that this Agreement is binding.
You have released any and all claims against the indemnified parties
resulting from your participation in the educational assistance,
including any claims caused by the negligence of the indemnified
parties.
YOU HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENTS. YOU
CERTIFY THAT YOU ARE 18 YEARS OF AGE OR OLDER, AND ACCEPT THIS AGREEMENT
OF YOUR OWN FREE WILL. ALL
DONATIONS/MONEY RECEIVED FOR SEMINARS, VIP MEMBERSHIP OR OTHER PRODUCTS
ARE NON-REFUNDABLE. YOU RESERVE ALL YOUR RIGHTS NOT GIVEN UP AND AGREED
UPON IN THIS TOS/AGREEMENT. |
